Weblabor General Terms and Conditions
Last updated: October 29, 2026
Service Provider: Carlos Eli Escobar Ruiz, individual person, with business name WebLabor («Weblabor»), RFC EORC9302022E9, with address at Calle 19 #135 corner 32, Colonia Chuburná de Hidalgo, Mérida, Yucatán, Mexico.
1. Object and nature of general conditions
These General Terms and Conditions are intended to establish the general rules applicable to the commercial and operational relationship between Weblabor and its clients, regardless of the specific service, product or solution contracted, unless a quotation, contract, plan or particular conditions expressly establish a different rule.
These conditions aim to facilitate a professional, clear and good faith relationship, defining reciprocal responsibilities, communication mechanisms, operating rules and general criteria to prevent or resolve disputes.
The specific conditions of each service shall supplement these rules and, when they expressly provide for something different, shall prevail with respect to the specific point regulated.
2. Professionalism, respect and resolution of disagreements
Weblabor and the Client, as well as any individuals acting on behalf of either of them, shall endeavor to maintain respectful, professional communication oriented toward resolving matters related to the service.
The Client retains at all times the right to express complaints, question decisions, report errors, request clarifications, or voice disagreement. The existence of a complaint does not in itself constitute improper conduct.
The parties shall endeavor to avoid insults, threats, harassment, shouting, personal attacks, disqualifications, sarcasm or expressions that substantially impede the understanding or resolution of the matter.
Expressions such as a function being "obvious," that "all systems have it," or that a modification "should be easy" may be part of a conversation, but they do not substitute for an objective specification of the expected behavior, scope, or result.
When an interaction ceases to be productive due to objectively aggressive conduct or repeatedly disruptive behavior, either party may point out the situation and seek to redirect the communication.
If this is not possible, the specific meeting, call or conversation may be terminated and resumed later under conditions that allow for professional communication.
The interruption of a specific interaction shall not in itself entail the termination of the contract or a breach.
3. Direct channel restriction due to repeated incidents
In cases of serious conduct or repeated incidents that substantially hinder the proper provision of the service, Weblabor may temporarily or indefinitely limit certain direct or synchronous channels, such as calls, video calls or instant messaging, and continue assistance through tickets, email or other official written channel that allows maintaining clarity and traceability.
The restriction of a channel should not be interpreted as a denial of service as long as a reasonable official mechanism remains available for the corresponding assistance.
When a contracted service expressly includes meetings, synchronous support or another specific channel as part of its services, the particular conditions applicable thereto shall apply.
4. Official communication channels
Weblabor may determine and communicate the official channels for requests, follow-up, authorizations, support and other communications related to services.
Today, the official Weblabor customer service channel is WhatsApp +52 999 371 0986. Weblabor may enable other channels, such as a ticket system within its platforms, and will inform the Customer about them.
These channels may change over time without implying a substantial modification of the service, provided that the Customer is informed of the current mechanisms.
Telephone numbers, messaging accounts, emails or personal profiles of Weblabor members will not be considered official channels unless expressly designated.
The occasional reading or response to communication sent through a personal channel does not make that channel an official one, nor does it obligate future availability through that means.
When a request is sent outside official channels, Weblabor may ask that it be transferred to the appropriate medium for its registration and tracking.
If the Client insists repeatedly on using personal or unauthorized means after being informed of the appropriate channel, such personal contacts may be muted, restricted or blocked, without this constituting suspension or denial of service as long as official channels remain available.
5. Hours, Service and Priority
Unless the particular conditions of a service establish otherwise, ordinary Weblabor assistance is provided Monday to Friday, from 9:00 a.m. to 6:00 p.m. (Mérida, Yucatán time), or within the current business hours communicated to the Client.
Sending messages outside these hours does not obligate their reading, response, escalation, or immediate resolution.
The reiteration of messages, calls, the use of expressions such as "urgent," or simultaneous contact through multiple channels does not in itself modify the applicable priority, response time, or level of attention.
Priority can be modified when objective information is provided that justifies a different classification according to service conditions.
Response times and resolution times are distinct concepts.
When there are service levels, priorities, on-call services or out-of-hours support, these shall be defined in the corresponding particular conditions.
Extraordinary or exceptional service provided outside the contracted conditions does not by itself create a permanent obligation to continue providing it on equal terms.
6. Remote mode and in-person services
Unless expressly agreed otherwise, Weblabor operates under a remote service delivery model.
As a result, meetings, presentations, training, support, implementation, delivery, and other activities may be conducted through digital means when the nature of the service permits.
The prior execution of a sale, demonstration, meeting, visit, presentation, or in-person delivery does not by itself generate an obligation for future activities to be conducted in-person.
When the Client requests in-person service not originally included, Weblabor may offer it subject to availability and additional quotation.
Personnel time, transfers, transport, travel expenses and other related costs may be considered, among other concepts.
Date, time, location, duration, and costs must be agreed upon in advance and may require advance payment.
The Client may not subsequently impose an in-person modality, a specific person, a determined date, or any other condition not contracted as a requirement to recognize the fulfillment of a service originally agreed under different conditions.
7. Hiring with Weblabor and staff assignment
Except where the personal provision of a specific member is expressly established, the Client enters into a contract with Weblabor as a provider and not with a specific natural person.
Weblabor may provide the services through employees, collaborators, suppliers or authorized personnel and may reassign those responsible when necessary for service continuity or organization.
A person's participation in a sale, presentation, negotiation, initial meeting, or prior service does not create the right to require that same person to continue personally providing the service.
The Client may reasonably request a change of contact person when there is an operational or communication difficulty, without this implying the right to unilaterally select a specific person.
8. Authorized Representatives of the Client
The Client will be responsible for determining the authorized persons to provide instructions, request changes, approve decisions, or participate in official channels.
Unless expressly stated otherwise, Weblabor may reasonably consider the instructions from persons that the Client itself incorporates or allows to participate in said channels as authorized.
The Client may report authority restrictions or designate a primary responsible person whose instructions shall prevail in case of contradiction.
Changes to such authorizations shall take effect prospectively and shall not invalidate instructions that Weblabor had reasonably accepted prior to receiving the corresponding notification.
When two apparently authorized persons provide contradictory instructions before execution, Weblabor may suspend the affected activity until receiving clear definition from the Customer.
The waiting time resulting from such contradiction will not be attributable to Weblabor.
If an authorized instruction has already been executed and subsequently another authorized person requests to undo or modify it, the new instruction may be considered an additional request and subject to the costs, times or conditions of the corresponding service.
For sensitive decisions, including additional expenses, cancellations, deletion of information or other matters of special relevance, Weblabor may request confirmation from the account holder, primary representative or person with sufficient authority.
9. Authority to modify Weblabor commercial conditions
The technical possibility of carrying out an activity, a preliminary conversation, or the manifestation that something "can be done" does not in itself imply that such activity is included within the scope of the contract, that it is free of charge, or that it modifies the current commercial terms.
Discounts, bonuses, free developments, credits, free extensions, special promotions, price changes, forgiveness, or other extraordinary business terms must be formalized through the applicable official instrument or channel, such as an updated quote, sales note, contract, promotion, or authorized written confirmation.
When Weblabor formally offers a promotion or special condition, the Client accepts it and meets its requirements, Weblabor must respect it in accordance with its terms.
Before its formalization, if the circumstances or conditions that gave rise to the proposal materially change, it may be recalculated or withdrawn.
10. Quotes, scope and acceptance
Each service will be provided according to the scope, method, price, and conditions established in the quote, contract, plan, subscription, hour package, or other applicable instrument.
The parties shall endeavor to review and clarify errors, inconsistencies or ambiguities before acceptance.
When a quote is modified, Weblabor may retain successive versions to clearly identify which version was finally accepted.
Acceptance should be linked, to the extent possible, with the version, date, and conditions in effect at the time of acceptance.
The Client shall not unilaterally add, after contracting, new delivery conditions or performance requirements that were not part of the original agreement.
Additional requests will be analyzed in accordance with the particular conditions of the corresponding service.
11. Complimentary amenities and additional services
Weblabor may, at its discretion, provide the Customer at no cost certain adjustments, functionalities, advice, support, expansions, services or other benefits that are not part of the contracted scope.
These benefits shall be offered as a courtesy unless they are expressly incorporated into the scope through a formal instrument.
The acceptance of providing a courtesy does not modify the price, scope or original obligations and does not automatically subject it to the response times, priority, delivery date, warranty or service level applicable to contracted and paid services.
Your scheduling may be carried out according to Weblabor's operational availability.
The Client may request reasonable information about a courtesy, but may not treat it as a contractual obligation, use its delay as the sole basis for non-compliance, or condition previously acquired payments or obligations upon the fulfillment of the courtesy.
The granting of one or more similar courtesies does not create an acquired right nor automatically incorporates said benefits into future contracts.
Weblabor may withdraw a pending courtesy when circumstances make it unviable or inconvenient to continue it, especially when it is intended to be converted into an enforceable obligation or used to condition the Client's obligations.
If the Client requires that a service initially offered as a courtesy have a committed date, priority, execution guarantee, or other enforceable conditions, they may request its formal incorporation into the scope and, if applicable, the corresponding quotation.
12. General payment rule
Except as the quote, contract or particular conditions expressly establish a different arrangement, Weblabor services shall be subject to advance payment for the applicable amount before their activation, commencement, renewal or provision.
A payment will be considered made when funds have been effectively received and confirmed by Weblabor.
A receipt, screenshot, transfer instruction, or pending credit transaction does not by itself constitute confirmed payment.
Partial payments will only produce the agreed effects when the installment method has been previously accepted.
Unilateral payment of an amount less than required does not modify the agreed conditions or obligate Weblabor to initiate, activate, renew, deliver, or continue a service.
Partial amounts received will be recognized as credits to the corresponding transaction, without this implying the automatic creation of financing or a different payment method.
In case of cancellation, return, or termination, the corresponding rules for the service and applicable legislation will be applied.
Exceptions, facilities, or payment modalities granted in one transaction do not by themselves generate the right to demand equivalent conditions in subsequent transactions.
13. Surpluses, credit balances and application to debts
When a payment exceeds the balance of the transaction to which it corresponds, the excess may be recorded as a credit balance for the Client.
If the Client has other overdue or payable debts with Weblabor, said balance may be applied to those debts, leaving a record of its application.
When there are no other outstanding amounts, the credit balance may be maintained for future transactions or returned to the Client, as applicable and agreed between the parties, considering the applicable administrative, accounting, and tax requirements.
14. Information and dependencies in charge of the Customer
When to initiate, execute, continue or deliver an activity Weblabor requires information, access, files, content, authorizations, decisions, payments, validations or other elements under the Client's responsibility, the deadlines that depend on such elements will begin to run once Weblabor has what is necessary to carry out the corresponding activity.
Delays directly caused by the lack, insufficiency, or delay in the delivery of these elements shall not be attributable to Weblabor and may proportionally affect the originally scheduled timelines.
Particular conditions may establish additional rules for each service.
15. Abandonment, Unilateral Termination, and Third-Party Contracting
The Client's unilateral decision to stop using a service, suspend their participation, contract a third party, or terminate the relationship does not by itself prove a breach by Weblabor nor automatically generate a right to reimbursement.
The existence of an incident, error, or complaint does not automatically constitute a breach.
When applicable, the contracted obligation, the circumstances of the case, and the reasonable opportunity for service delivery in accordance with the conditions of service should be analyzed.
The foregoing does not limit the liability that corresponds to Weblabor when there is indeed a breach attributable to it.
16. Cancellations and returns: general principle
Payments made will not be automatically refundable solely because the Client changes their mind, stops using the service, or requests its cancellation.
The origin and, where applicable, the amount of any refund will depend on the nature of the service, the particular conditions, the work performed, the costs or commitments incurred, and the applicable legislation.
When there is a breach attributable to Weblabor, the situation will be analyzed in accordance with the obligation effectively contracted, the particular conditions, and the rights that correspond to the Client in accordance with applicable legislation.
17. Exceptions and absence of precedent
Courtesies, facilities, tolerances, extraordinary attention, in-person services, out-of-hours attention, exceptional use of personal channels, special payment methods, or other exceptions granted on one occasion shall not by themselves modify the general or particular conditions nor create an obligation to repeat them in the future.
18. Meetings when they are part of the service
When a service involves meetings, the parties shall endeavor to respect the agreed schedules, provide necessary information in advance, and use the time in a reasonable and productive manner.
Specific rules regarding tolerance, cancellation, rescheduling, duration, no-show, or time consumption may be established in the particular conditions of the service.
A meeting may be terminated when circumstances of unproductive communication or conduct as provided in these terms occur, without prejudice to the matter being able to continue subsequently through an appropriate channel.
19. End of relationship
Notwithstanding the specific causes and procedures provided for in each service, either party may terminate the relationship in the cases permitted by the applicable agreement and legislation.
In cases of serious or repeated conduct that makes it unfeasible to maintain a professional relationship, Weblabor may consider terminating the commercial relationship, while respecting any outstanding obligations that apply.
The termination must consider, according to the nature of the service, existing payments and debts, work actually performed, active services, information, access, deliverables and other obligations that must remain in effect or be concluded.
Particular conditions may establish additional procedures.
20. Complementary nature of particular conditions and order of precedence
These General Terms and Conditions constitute the common framework of the relationship with Weblabor.
Each product or service may have particular conditions that regulate aspects inherent to its nature, including technical scopes, special payments, deliveries, warranties, support, service levels, licenses, infrastructure, development, or other specific elements.
If two documents contradict each other, they are applied in this order:
- The quotation or written agreement that the Customer accepted, insofar as it expressly regulates.
- The particular terms and conditions of the service or product accepted by the Customer.
- These General Terms and Conditions.
In case of contradiction regarding a point expressly regulated by particular conditions accepted by the Client, the particular provision shall prevail for that service, without affecting the application of the rest of these General Terms and Conditions.
21. Personal information
Weblabor processes personal data it receives in accordance with its Privacy Notice, published on this same "Legal" page of weblabor.mx.
22. Acceptance, Notices, and Applicable Law
The Client accepts these terms and conditions by hiring, paying for, or using a Weblabor service, or by accepting a quote that mentions them.
Weblabor notices to the Customer are sent to the Customer's registered email or through the official support channel. Customer notices to Weblabor are made through Weblabor's official support channels or to the service provider's address indicated above.
Weblabor may update these terms and conditions. Changes are published on this page with their "Last updated" date and are notified to the Client's registered email with at least five business days' notice before they take effect. They do not affect what has already been paid or services already contracted and in progress, unless the Client accepts them.
These conditions are governed by the laws of Mexico. For their interpretation and compliance, the parties submit to the competent courts of Mérida, Yucatán, unless the law grants the Client another jurisdiction that cannot be waived.
